Osram Relaxed about Samsungs Counter Claims in Korea

Osram had not seen Samsung’s complaint yet and did not know its specific content which has been issued in Korea. According to a spokesperson, Osram is well prepared regarding possible steps by Samsung and is therefore relaxed about the move by the counter claimant. Osram regards Samsung’s move as a typical counter attack of a defendant. Anticipating this move Osram had analyzed Samsung’s patent portfolio thoroughly before taking any legal actions and concluded that none of Samsung’s IP will cause a problem for any of OSRAM’s products.

Osram had a long standing tradition in handling inventions and patent rights conscientiously - it holds around 8000 patents around the globe. Osram therefore fully respects patent rights of third parties. Osram therefore expects other companies to also respect its patent rights and to use them in a legally correct way.

All major competitors recognized the value of the important Osram conversion principle by taking royalty bearing licenses, states the global lighting company. Osram could not accept that companies used its patents without authorization. Therefore Osram was forced to take legal actions against Samsung and LG and filed suits in the U.S., Germany, China and Japan on June 4, 2011 and on June 6, 2011, after preceding negotiations failed.
