Nichia settles with creative technology in U.S. litigation

Nichia Corporation announced today the settlement of its pending design patent litigation in the U.S. between Nichia and Creative Technology Ltd, Creative Holdings Inc. and Creative Labs Inc.

On January 10, 2006, Nichia filed a Complaint in the Federal Court for the Northern District of California against Seoul Semiconductor Ltd. and its U.S. subsidiary Seoul Semiconductor Inc., as well as against Creative Technology Ltd and two of its U.S. subsidiaries, who had sold products which incorporated the LEDs manufactured by Seoul Semiconductor, alleging that they infringe 4 of Nichia’s design patents.

The parties have arrived at a commercial settlement which will be mutually beneficial.

NICHIA gives serious consideration to the protection of its intellectual property and will vigorously enforce its intellectual property rights in any country.

Pursuant to this settlement between Nichia and Creative, claims against the Creative Defendants will be dismissed in the pending lawsuit in California, while the case continues between Nichia and Seoul Semiconductor.
