Samsung LED Extends Infringement Lawsuits Against OSRAM to the United States
Samsung LED Co., Ltd. filed a complaint with the United States International Trade Commission (“ITC”) in which it has requested the ITC to issue an exclusion order barring importation of products of OSRAM, OSRAM Opto Semiconductors, and OSRAM Sylvania Inc. into the United States. Samsung LED also filed suit for patent infringement in the United States District Court for the District of Delaware to seek damages and a permanent injunction barring OSRAM’s infringement. Intematix Awarded Sixth Patent for Remote Phosphor LED Lighting Designs
Intematix Corporation, a leading innovator of patented phosphor materials and components for high-quality LED lighting, has been awarded a sixth remote phosphor patent by the U.S. Patent and Trademark Office. Intematix’s new patent will help designers develop a new generation of high-efficiency LED lighting fixtures. This latest patent marks the fourth remote phosphor patent Intematix has received this year. Two Lawsuits Filed Again against EVERLIGHT's White LED Products
On October 4, 2011, Nichia Corporation ("Nichia"; head office: Anan-Shi, Tokushima Prefecture, Japan; Representative Director: Eiji Ogawa) has filed two patent infringement lawsuits in Tokyo District Court to enjoin Tachibana Eletech Co., Ltd. ("Tachibana"; head office: Osaka-Shi, Osaka Prefecture, Japan; Representative Director: Takeo Watanabe) from infringing Nichia's patent (No. 4530094, or "patent No. 094") and to claim damages for the infringement with regard to white LED products (product number: GT 3528 series and 61-238 series) manufactured by EVERLIGHT ELECTRONICS Co., Ltd. ("Everlight"; head office: Tu-Cheng City, Taipei County, Taiwan; Chairman: Robert Yeh), the largest LED assembly manufacturer in Taiwan, and imported, sold, etc. by Tachibana. Read more »

Higher Regional Court Karlsruhe Confirms OSRAM Patents
The higher regional court Karlsruhe confirmed that Malaysian LED manufacturer Dominant is illegally using or has used OSRAM AG technology with seven patents. As the court of first instance, the regional court Mannheim already reached the same verdict regarding three of these patents on July 25, 2007. OSRAM had sued the manu-facturer on several patents and industrial properties. “The ruling of the court of appeal in Karlsruhe is an important confirmation of our intellectual property rights”, said Aldo Kamper, CEO of OSRAM Opto Semiconductors. Rejection of Osram’s Infringement Case vs. Dominant Issued by OLG Karlsruhe
The OLG Karlsruhe and the Landgericht Mannheim has confirmed that 10 of the claims against DOMINANT are not valid. As a result of the proceedings, the Federal Patent Court of Germany have also nullified 4 out of 7 Osram intellectual property rights and the European Patent Office has revoked one. Seoul Semiconductor and Philips Enter Into a Cross-License Agreement
Today, Seoul Semiconductor Co., Ltd. announced that they and Royal Philips Electronics have agreed to settle their pending legal cases and to enter into a cross-license agreement covering patents relating to specific LED technology areas. Under this arrangement, each party gains access to a substantial part of the other party's patent portfolios for various LED level technologies. Read more »

Everlight Fights Back Against Nichia in LED Patent Battle
After Everlight won a victory over Nichia for the patent administrative litigation (Patent No. 089036) in the Taiwan Supreme Administrative Court in October 2011, the Taiwan Supreme Court this November ruled in favor of Everlight again in the civil infringement case on Nichia’s patent in issue, which finalizes all cases regarding this patent. Furthermore, facing the situation that Nichia has affected fair competitive market mechanisms by filing patent infringement lawsuits and announcing press releases, Everlight decided to fight back. Today (12/1), Everlight brought a lawsuit in the Tokyo District Court demanding that Nichia stop spreading false allegations and seeking an award of damages. Read more »

On December 20th, 2011, Mitsubishi Chemical Corporation (“MCC” “; Head office: Minato-ku, Tokyo; President: Yoshimitsu Kobayashi), has filed an infringement lawsuit in Seoul Central District Court against a USpany, Intematix Corporation and a Korean distributor, GVP, to enjoin them from importing and selling their phosphor products, claiming that they infringe a red phosphor patent in Korea (No. 816693) which is owned by MCC and National Institute of Material Science. Power Integrations announced a verdict reached in the company's 2008 patent-infringement lawsuit against Fairchild Semiconductor.
